GENERAL LIABILITY WAIVER AND HOLD HARMLESS AGREEMENT FOR JAM IN THE VAN’S SPEAKEASY SESSIONS
I represent that I am a legal, responsible adult. I represent and warrant that I am signing this document for myself and all others who may claim by, under, or through myself, regarding my in-person attendance at the Jam in the Van (“JITV”) Speakeasy Sessions event located at their venue on JITV’s property. I am fully aware of the risks and dangers of such attendance. I understand that my attendance and the usage of the JITV venue is voluntary, at my own risk, and that JITV is not responsible in any manner for my event attendance or venue usage, or for any personal injury or property damage to me as a result of the usage of the JITV facilities. I acknowledge that, in the middle of a global pandemic, there is a serious risk that, by using the facility, I could contract a dangerous virus or other health condition, and that I accept this risk and nonetheless voluntarily choose to attend this Speakeasy Sessions event and to use the facility.
In consideration of my being allowed to enter the JITV venue during the COVID-19 pandemic and for other good and valuable consideration, receipt of which is hereby acknowledged, on behalf of myself, and all others who may claim by, under, or through myself, I do hereby agree to indemnify and hold harmless and do hereby release, acquit, and forever discharge JITV and, without limitation or exception, all of JITV’s owners, members, officers, employees, agents, assigns, sponsors, performers and their associates, and all other related persons or companies (all of the above, the “JITV Related Parties,” from any and all claims, actions, or causes of action which I now have, or which may hereafter accrue, whether for personal injury or property damage, whether known or unknown, arising out of or in any way resulting from my event attendance and/or usage of the JITV venue during the COVID-19 pandemic. I acknowledge that the JITV facility has posted warnings and medically appropriate sanitary protocols at the venue location and I understand the content of the postings and have advised any third parties whose interests I represent, as parent or guardian, of said content.
I further agree to indemnify, defend, and hold harmless JITV, and all JITV Related Parties, from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against JITV, and all JITV Related Parties, due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to any of the JITV facilities, whether caused by the negligence of JITV, or otherwise, specifically related to COVID-19.
